Node service terms of use

This agreement governs your rights, obligations, and billing while using KuzCloud Apple Silicon dedicated nodes. Logging into the console, completing checkout, or otherwise accessing the platform means you have read and accept all terms.

When the agreement binds you

Your contractual relationship with KuzCloud

This document is the Terms of Service. “You” means the account holder or the party actually operating the service.

You are deemed to have read and agreed to this agreement in full if any of the following applies:

  • You click buttons such as “Agree” or “Confirm” during registration, sign-in, or checkout;
  • You access the website, console, or APIs in any manner;
  • You complete account activation.

If you do not accept any term, stop using the service immediately.Users under 18 may not register or use this service.

What the platform delivers

Remote compute on Apple Silicon models such as Mac mini M4

Core platform capabilities include (subject to features actually shipped):

  • Dedicated physical nodes billed by day / week / month / quarter
  • Direct SSH command-line access
  • VNC graphical desktop access
  • Public connectivity and bandwidth allocation
  • Basic technical support

We may adjust, add, or remove features without prior notice; delivery is as actually provided, and we owe no compensation for feature changes.

Account rules

Accurate information, one account per person, you safeguard credentials

Registration information

You must provide information that is true, accurate, and complete, and update it when it changes; you bear consequences of inaccurate data. Each person may hold only one primary account.

Credential security

You keep passwords and all login credentials; actions under the account are deemed yours. If the account is compromised, notify us via ticket promptly; we are not liable for activity before we learn of the compromise.

Accounts are non-transferable

Without written authorization, you may not sell, lend, or sublease the account or its benefits. Violations may lead to immediate suspension with no refund of fees paid.

Prohibited conduct

Resources may be used only for lawful purposes and must comply with applicable law

We may terminate service immediately with no refund if we find any of the following:

  • Violating laws or regulations of any country or region
  • Launching network attacks, DDoS, scanning, or penetrating others’ systems
  • Sending spam or conducting phishing
  • Distributing malware, viruses, ransomware, or other harmful code
  • Mining cryptocurrency without authorization
  • Operating proxies, VPNs, or large-scale traffic relay without written permission
  • Infringing third-party IP, privacy, or other lawful rights
  • Harming platform facilities, network stability, or other users’ interests
  • Attempting to bypass platform security or technical restrictions
We may reasonably monitor usage. If misuse is suspected, we may suspend nodes without prior notice and investigate; fees continue to accrue per this agreement during investigation.

Payment and renewal

USD prepay, renewal under your control, price changes do not apply to the current period

Prepay and billing tiers

Fees are quoted in USD and must be prepaid before the node starts. Confirmed billing tiers (day / week / month / quarter) may not be shortened to a shorter tier; amounts paid are non-refundable.

Auto-renewal

If you do not disable auto-renewal in the console before the current period ends, the system will charge and renew at the same tier.

Pricing changes

We may change prices; purchased periods keep their price, and new prices apply from the next billing cycle.

Taxes

Prices shown exclude applicable taxes; you are responsible for any tax obligations arising from use of the service.

Availability and maintenance

We strive toward a monthly network availability target; maintenance windows are described separately

Availability target

We target monthly network availability99.0%as an engineering goal (excluding planned maintenance and force majeure). This figure is an internal engineering target and is not a legally binding SLA.

Maintenance

Planned maintenance will be announced when possible; emergencies may proceed without notice. Downtime during maintenance is excluded from availability calculations.

Fair use of resources

Each node has defined CPU, memory, disk, and bandwidth. If your traffic patterns or operations unreasonably impact shared networks or other users, we may throttle or suspend resources without further notice.

Data backup notice

We do not back up your data for you; data is permanently erased after expiry

You are solely responsible for backing up data on the node.We are not liable for data loss or inability to recover for any reason, including but not limited to:

  • Hardware failure or accidental damage
  • Data deletion after service termination or account suspension
  • Misoperation or software defects
  • Force majeure such as natural disasters

After subscription expiry or service termination, node data will be permanently erased within 72 hours. The operation is irreversible. Be sure to migrate important data before then.

We recommend syncing critical data to separate object storage, off-site repositories, or other cloud storage, with offline or cross-region redundancy.

Intellectual property

Platform UI and code belong to KuzCloud; data on your node remains yours

Site UI, branding, copy, components, software code, and API documentation are KuzCloud intellectual property and are legally protected; you may not copy, adapt, or redistribute them without permission.

Ownership of data you store on the node is unchanged. For hosting and data transfer, you grant us a limited, non-exclusive technical processing license for the service term.

You agree we may use operational metrics in anonymized, aggregated form to optimize performance and develop features.

Disclaimer

Disclaimer of implied warranties to the fullest extent permitted by law

Except where mandatory law requires otherwise, we make no implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not responsible for:

  • Outages caused by backbone or carrier failures
  • Force majeure such as natural disasters, war, government action, epidemics
  • Third-party failures such as payment providers or upstream bandwidth
  • Hacking or malicious third-party acts
  • Damage or data loss from user error
  • Third-party claims arising from content you host
  • Suspensions required by courts or regulators

Liability cap

Aggregate liability is capped at recent fees actually paid

For all claims related to this agreement or the service, KuzCloud’s aggregate liability shall not exceed the service fees you actually paid to us in themost recent calendar monthbefore the dispute arose.

The following damages are excluded even if we were told they might occur:

  • Indirect, incidental, special, or punitive damages
  • Loss of profits, business opportunities, goodwill, or commercial value of data
  • Losses from business interruption

If the law of a specific jurisdiction does not allow the above limits, they apply to the maximum extent permitted there.

Service suspension

You may disable renewal; we may terminate immediately under certain conditions

Termination by you

You may disable auto-renewal anytime in the console; the node stops at the end of the current period, and fees paid are non-refundable.

Suspension by platform

We may suspend or permanently terminate service immediately without prior notice and without refund if:

  • You violate Section 4 prohibited conduct
  • Invoices are more than 72 hours overdue
  • Fraud is suspected or the service is used for unlawful purposes
  • Law enforcement or regulators require cooperation
  • Conduct seriously harms platform infrastructure or other users

Data deletion

After service termination, we willwithin 72 hourspermanently delete all node data associated with the account; the action is irreversible.

Agreement updates

The online published version controls; continued use means you accept updates

We may revise this agreement from time to time; revisions take effect after we publish this page and update the date at the top.Continued use after updates means you accept the revised terms.If you disagree with a revision, stop using the service before it takes effect; for purchased periods that have not yet expired, the pre-revision version still mainly governs.

Governing law and disputes

Good-faith negotiation first; if that fails, submit to a court of competent jurisdiction

Disputes should first be handled via ticket; we will provide an initial response within about5 business daysand seek resolution through consultation.

Governing law

Formation, validity, interpretation, and dispute resolution of this agreement are governed by the laws of the People’s Republic of China (excluding conflict-of-law rules). If consultation fails, disputes shall be submitted to the people’s court with jurisdiction where the operating entity is located.

Severability

If any clause is held invalid, it shall be adjusted to the minimum extent necessary; the remaining clauses remain in effect.
